All passengers, vehicles and freight are transported subject to the following conditions:

GENERAL

In these terms and conditions (where not inconsistent with the context): "Booking" means the booking entry made with and accepted by the carrier in relation to the travel or accommodation sought by or on behalf of the customer, the boarding pass, or any other document or message of the carrier issued by or on behalf of the carrier as part of or relating to the contract for carriage concerning such travel or accommodation; The "Carrier" is Moreton Island Ferries Pty Ltd ("MIF"), and includes the carrier which accepts the booking and all carriers that provide transport and services to the customer and any of the carriers' agents, servants, representatives or contractors; "Customer" means the entity or person specified as receiving transport and other services in the booking and any infant or baggage with that person. "Trade Practices Act" means the Trade Practices Act 1974(cth).
These terms and conditions are governed and construed in accordance with the laws in force in the State of Queensland. The parties submit to the non-exclusive jurisdiction of the Courts of the State of Queensland.

CHANGING OR CANCELLING YOUR BOOKING

ALL BOOKINGS ARE NON-REFUNDABLE. This includes vehicle fares, vehicle permits, passenger fares, day tour fares, accommodation charges, parking or freight fees.

To cancel or change your booking, please read through the below cancellation and changes policy. To make amendments to your booking, please contact our office on 07 3909 3333.

If MiCat is not given minimum notice of your booking, or you do not show on your selected travel date, unfortunately you forfeit your fares paid. All bookings booked as "MICAT RETURN" are based on a package basis where the cancellation policy stands for both legs of the package. If notice is not provided when cancelling the booking the entire "RETURN" booking will be forfeited. Notice for cancellations is based on the travel to Moreton Island date. If you have cancelled your booking, please keep this booking number located at the top right hand corner. When you would like to rebook your credit please contact our office on 07 3909 3333 and quote your booking reference number.

 

If any change/s to the dates of travel are approved as per our notice period requirements, then the current price rates applicable to the new travel dates will be applied to the booking. Any increase in charges will be payable by the customer at the time of making the change. No refunds will be issued if there is a reduction in the price.

 

Bookings made as return packages, consisting of two legs of travel, are considered to be one booking for the purpose of these terms and conditions. For clarity, if you do not provide notice of changes prior to the departure of the first leg of travel, you will forfeit the full return fare. At any time prior to your departure, including a return leg of a return package, you can choose to list as a standby Booking on a different trip to that booked. In this case your travel will be subject to the availability of space and at the discretion of the Skipper. There is no rebooking fee if you are able to board the standby trip. If you are unable to board the standby trip, your original booking stands.

 

Moreton Island Adventures may need to cancel, delay or reschedule our services due to unsuitable weather conditions, technical problems, operational reasons, or any event beyond our reasonable control. Scheduled departure times are not guaranteed. Moreton Island Adventures are not liable for any loss which you may incur as a result of any such delayed or rescheduled service.

 

BOARDING AND TRAVELLING

You must arrive at the Port of Brisbane Terminal 60 minutes prior to your scheduled departure time to allow enough time for ticketing and boarding. Unless requested otherwise via email or a staff member of Moreton Island Adventures, please note that if you are travelling on the below services you are required to arrive:-

1. Friday and Saturday 8:30am service to Moreton Island

- required to arrive between 1.5 hours prior the departure time (ie. between 7:00am - 7:30am).

2. Friday and Saturday 1:00pm service to Moreton Island

- required to arrive 30 minutes prior to the departure time (ie. 12:30pm)

3. Sunday 2:30pm service to Moreton Island

- required to arrive 30 minutes prior to the departure time (ie. 2:00pm)

At the beach pickup points on Moreton Island, you must arrive 30 minutes prior to your scheduled departure time. Failure to arrive at the departure point within these timeframes may cause you to miss your travel and forfeit the fare paid.

The two (2) passengers included in the cost of the vehicle and / or trailer must travel with the vehicle and / or trailer.
The vessel is fully licensed; no pre purchased alcohol is permitted to be consumed on board. The Terminal area is an unlicensed public area, and no alcohol is permitted to be consumed within the boundaries of the Terminal.
Smoking is not allowed on board the Micat Vessel. There is one designated smoking area at the Terminal, which is the only area in the Terminal where smoking is permitted.

TRAVEL INSURANCE

Holiday and travel plans can be disrupted by many unforeseen circumstances and cancellation fees can be costly. Travel insurance is inexpensive and highly recommended.

CONDITIONS OF CARRIAGE

A Customer may be refused entry, be requested to leave the vessel or other means of transport or be physically restrained or removed if: the Customer is in breach of these terms and conditions, objectionable to other Customers or is, for any reason, disturbing, causing discomfort to or threatening the safety or security of other Customers, any property or the Carrier; the Customer is under the influence of alcohol or drugs or is not physically or mentally fit to travel; the Customer requires medical or other special assistance; in order to comply with any applicable laws, regulations, or orders. The Carrier is not liable for any Loss which the Customer incurs as a result. The carrier reserves the rights to search any vehicles, baggage and/or freight. Prior to travel, Customers must present all valid travel documents. The Carrier reserves the right to refuse carriage if a Customer does not comply with these requirements. Carriage pursuant to the booking and on these terms and conditions is provided subject to the provisions of the Trade Practices Act, and applicable state and territory legislation. The carrier is not a common carrier and may refuse to carry any person, vehicle, freight or baggage, whether or not a booking has been accepted or processed by the carrier, without any obligation to provide reasons for such refusal. The Customer acknowledges that the carrier may need to cancel, delay and/or reschedule trips or services due to unsuitable weather conditions, technical problems or any event beyond the carrier's reasonable control, and scheduled times are not guaranteed. Subject to the provisions of these terms and conditions of carriage, the Trade Practices Act and applicable state and territory legislation, the carrier is not liable for or in connection with loss or damage sustained to baggage, injury or death of any person, direct, consequential or indirect loss or damage arising out of or in any way connected to the provision of transport and other services to the Customer (whether arising from negligence or omission or any other cause, including for costs or losses resulting from cancellation of trips and or services, delay or rescheduling, substitution of means of transport, or any other change to the transport or services described in or covered by the booking) inaccuracies or errors in any information relation to transport, services or pricing. To the extent permitted by law, any liability of the carrier for a breach of any provisions of the contract of carriage or related obligations shall not exceed resupply of the payment of the cost of resupply of the service in question. These terms and conditions of carriage may not be modified or waived by any person. Use of this ticket constitutes acceptance of and agreement to be bound by all the terms and conditions printed hereon and an acknowledgement that the person who purchased the ticket was acting as the agent for the passenger. Any oral representations made by any person concerning the liability of the carrier, its servants or agents shall not be binding. All persons shall obey instructions given by employees of the Carrier

ACCOMMODATION

Accommodation bookings at the Moreton Island Eco-Village are made on the same terms and conditions as above. An acceptable form of photographic identification may be required on check-in. The credit card details used for booking the accommodation will be retained and used to recover any costs or charges incurred whilst at the property, even if you fail to settle any charges before departing. The Moreton Island Eco-Village is not a full service resort. Reservations of seven nights or longer will receive a complimentary mid-stay service, provided on the fourth day of each seven nights of the stay. Additional services are available for purchase. Standard check-in time is 2:00pm. Standard check-out time is 10:00am. To guarantee a room is available for arrival prior to 2:00pm, the room must be reserved from the previous night, by paying the nightly charge. Late check-out is at the discretion of the property manager. After 12:00pm a late check-out fee of $60 per hour or part thereof applies, up to a maximum of the full nightly rate. In the unlikely event that accommodation cannot be provided as previously confirmed, the Carrier will undertake to relocate you to alternative accommodation of equal or better quality, or otherwise refund the reduction in costs by relocating you to a property of lesser quality. The alternatives are offered at the Carrier's discretion. If you should choose to relocate to a property of your own choice, the Carrier is not responsible for any difference in price. Whilst care is taken to ensure descriptions of the facilities and services are accurate, these are continually being upgraded, changed and on occasion taken out of service. Requests for specific rooms are taken into consideration, however the final allocation of specific rooms cannot be guaranteed. If any feature, service, location or facility is essential for your stay, it is advisable that you check with our booking office at the time of booking. The Carrier cannot be held liable for omissions or errors, whether temporary or permanent of the property's facilities and service. Property photos may not be specific to the actual room allocated. Photos are indicative only.

CAR PARKING

You enter and use the car park at the terminal at your own risk. We are not liable for you or any person with you for: injury to you or anybody else; damage to, destruction of, theft of, or unauthorised operation of your vehicle or any vehicle whether authorised or not; or damage to, destruction of, or theft of any property (Including anything in or on your vehicle or any other vehicle); however caused, and you release and indemnify us from any claim, which you might otherwise have against us. You agree to indemnify us in respect of any claim made against us as a consequence of, in relation to, or in any way arising out of the use of this car park. We will not be liable to you for delivery of your vehicle to any person who did not have authority to take your vehicle. Infringement notices distributed for illegal parking in this car park are enforceable under contract law. A parking fee is payable each time a vehicle enters here. If you bring a vehicle into this car park you agree to pay the parking fee as set by us from time to time. You agree to:
produce and display when requested by us, your parking ticket as proof of payment of the parking fee;
not to cause any obstruction, and not to park anywhere that we designate as a no parking area;
not to use this car park other than in accordance with instructions that an authorised officer may give;
comply with all reasonable directions and requests made by an authorized officer.

EDUCATION CAMPS

All bookings for education camps are subject to the above terms and Conditions:
General; Boarding and Travelling; Travel Insurance; Conditions of Carriage; Accommodation; Car Parking; and in addition:
All bookings must be secured with a 25% deposit within 14 days of the date of booking. Failure to provide deposit will result in the forfeit of the dates requested. Upon receipt of deposit, your preferred dates will be reserved.
All application forms for National Parks and Wildlife educational camps and vehicle access permissions will be provided. Other documentation to include Sand Tobogganing and Snorkelling indemnity forms and will also be provided at the time of confirmation.
A final payment is due 30 days prior to the confirmed date of camp.
All details pertaining to final numbers, dietary requirements and special requests must be received no later than 14 days prior to travel. Any decrease in numbers inside 14 days will not be eligible for refund. (This is due to catering and accommodation costs outlaid). Any increase in numbers inside 14 days will be accepted providing there is a vacancy and will be charged additionally.
Cancellations must be advised at least 3 months prior to confirmed date. If this notice is given you may re use your deposit for future camps or receive a refund less an accounting fee of 10%. Cancellations advised up to 2 months prior may reclaim deposit for future camps or receive a refund less a late fee of 25%. Cancellations received up to 1 month prior will forfeit their deposit in full.
The Carrier may need to cancel, delay and/or reschedule activities or services due to unsuitable weather.
It is the school's responsibility to ensure that parents of students are given the option to advise of their children's medical requirements prior to the date of travel. This information should be forwarded to the Carrier and will be documented. It is the responsibility of the school representatives to dispense any medication to students with the permission of parents. The Carrier will under no circumstances dispense or administer any medication at any time.
A duty of care is owed to students in the school environment and while on excursions. The Education Department's duty of care owed to students for the duration of an excursion cannot be delegated from the school to parents, caregivers, volunteers or employees of external organisations.
To ensure the health and safety of students and staff, schools are required to proactively manage all aspects of a variation to school routine. The school's duty of care to students extends to school excursions and camps, which are integral to students' educational programs. Activities conducted away from schools may increase risks and therefore the standard of care required must reflect the increase in identified risks.

EVENTS AND CRUISES

All bookings for events and cruises are subject to the above terms and Conditions:
General; Boarding and Travelling; Travel Insurance; Conditions of Carriage; Accommodation; Car Parking; and in addition:
A deposit of 25% of the hire fee is required upon signing a hire agreement.
The balance of the Hire fee is payable fourteen days (14) prior to commencement of the Hire period.
Final numbers must be advised to the Carrier at least 14 working days prior to the date of event. This is the minimum cost that the Customer will incur. Each additional guest booked inside the 14 day period will be charged at the agreed rate of (price per person). Any decrease in numbers inside 14 days will not be eligible for refund. (This is due to catering and supplier costs outlaid).
In the event the Hirer cancels this agreement by notice in writing to the Carrier (Moreton Island Ferries Pty Ltd), 14 Howard Smith Drive, Lytton QLD 4178, more than 90 days prior to the commencement of the Hire period, the deposit will be refunded in full less a service fee of $250.00.
Where cancellation is made less than 90 days but more than 30 days prior to the commencement of the Hire period, 50% of the full deposit will be refunded less a service fee of $250.00
Where cancellation is made less than 30 days but more than 14 days prior to the commencement of the Hire period, the full amount of the deposit will be forfeited.
If cancellation is made less than 14 days prior to the commencement of the Hire period, the full Hire fee will remain due and payable and will not be waived or refunded.
The Carrier reserves the right to recall our vessel Micat at any time if the weather is considered to be a threat to safe operation of the vessel. During a recall the Hirer may be required to vacate Micat depending on conditions. The Carrier will not be liable for any lost time, expense or losses to personal goods or property due to recall. The Carrier is not liable to repay any Hire fees. The Hirer is advised to take out the appropriate insurance for such events.
In the event that a fault with the Micat is detected before or during the Hire period that may cause unsatisfactory performance of Micat or its equipment, the Carrier has the right to expeditiously affect repairs. In the event Micat is inoperable during part of the Hire period through no fault of the Hirer rendering total or premature termination of the Hire, the Hirer will be entitled to a pro-rata reimbursement of Hire fees
The use or consumption of illegal drugs by anyone using the facilities of the Carrier's property or boats, either ashore or afloat is prohibited. The consumption of alcohol or drugs may increase the risk of injury around docks, water and boats and the Hirer accepts that risk. The Carrier will not be liable for any personal injury, (including illness) or death arising from or in connection with the use or consumption of alcohol or illegal drugs.
The Carrier is entitled to dock and disembark any person who is, at the sole discretion of the Skipper engaging in unruly behaviour which could jeopardise the safety of the Micat vessel, its crew, The Hirer or its guests.
The Carrier and its insurance underwriters will not be liable for accidents, injuries or death due to: swimming; windsurfing; paddle boarding; the use of Micat's dinghy and outboard engine; or the use of snorkels, masks, fins or scuba equipment whether supplied by the Carrier or otherwise. The Hirer will ensure that, prior to use, that the user of the equipment referred to in this clause is experienced, qualified and capable of using the equipment, and the equipment is suitable and in good condition for the purpose for which it will be used and for the person using it.
The Carrier is customarily insured for the Hire period as protection against any accidental loss or damage that may occur, or be caused by, Micat during the Hire period so long as Micat remains in the cruising limits and perimeters. The Carrier may debit against the deposit any excesses in connection with claims made under the policy.
The Hirer is liable for all damage or loss caused by it, its friends, guests, invitees or other associates of the Hirer's party arising out of or in connection with its or any of the Hirer's party's acts or omissions or incurred by malicious wilful acts of the Hirer or members of the Hirer's party. The Hirer's liability extends to the Carrier's other parties to the full cost of making good any loss or damage. The Hirer acknowledges that under this agreement it is not insured for, and may be liable for damages to persons or property arising in whole or part from the negligence of the Hirer.
Should the Hirer require the engagement of third parties, such as caterers or entertainers, the Hirer will notify the Carrier and seek consent for the third party to join the Carrier. The Hire will not be unreasonably withheld by the Carrier. The Hirer will be responsible for the third party; Should the Carrier consent to the Hirer engaging the third party on Micat during the Hire, the Hirer and/or the third party will, prior to the delivery of the vessel;
a. Effect Public and Products Liability insurance covering the Hirer and the third party, for a sum of not less than $20,000,000;
b. Such policy will note the Carrier all of its respective rights, interests and liabilities;
c. Such insurance will be with an insurer acceptable to the Carrier which acceptance will not be unreasonably withheld;
d. The Hirer will provide a copy of the insurance policy to the Carrier within a reasonable time upon request, but in any case no later than 14 days prior to the commencement of the hire period.
To the extent permitted by law, the Carrier expressly disclaims all conditions and warranties, express or implied, in respect of the Hirer. Where the law precludes such exclusion and implies certain conditions and warranties into this agreement, the liability of the Carrier for breach of such condition or warranty shall be limited to the supply of the Hire.
Subject to these terms and conditions, the Hirer releases the Carrier from any liability to the Hirer for loss or damage, in contract, tort, equity, statute or otherwise, sustained by the Hirer or any other person in connection with this agreement or the subject matter of this agreement.
The Hirer will indemnify and keep indemnified the Carrier, each Owner Group Company, and each of their respective officers, employees, contractors and agents ("those indemnified") against:
a. any liability, loss, expense, damage or claims whether arising under any statute or at common law in respect of personal injury (including illness) to or death of any person;
b. a breach of this agreement by the Hirer;
c. damage to or destruction of the vessel;
arising out of or in connection with the Hire the subject of this agreement, except to the extent that such liability, loss, expense, damage, claims, breach, damage or destruction is caused by a negligent act or omission of any of those indemnified.
Each indemnity is a continuing obligation, separate and independent from the other obligations of the parties, and survives termination, completion or expiration of this agreement.
It is not necessary for those indemnified to incur expense or make any payment before enforcing a right of indemnity conferred by this agreement.

The Hirer will not assign or sub-hire its interest in the Carrier under this agreement without prior written consent of the Carrier. The Carrier may assign its rights under this agreement.
